By downloading, installing, or using the Webroom application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

Account access is subject to admin approval. We reserve the right to reject or revoke any account at our discretion.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate information when registering and keep it up to date.
• You must notify us immediately if you suspect unauthorised access to your account.
• You may not share your account credentials or allow others to access your account.

4. Acceptable Use

You agree not to use the App to:

• Transmit any content that is unlawful, harassing, defamatory, abusive, or otherwise objectionable.
• Impersonate any person or entity.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Attempt to gain unauthorised access to any part of the App or its related systems.
• Record, distribute, or publish conversations without the consent of all participants.
• Violate any applicable local, national, or international law or regulation.

5. Audio Rooms and Content

The App facilitates real-time audio communication between users within rooms. You are solely responsible for the content you transmit. We do not monitor room content in real time but reserve the right to investigate reports of violations and take appropriate action, including account suspension or termination.

Recordings made using the App's recording feature are saved locally on your device. You are responsible for ensuring you have obtained necessary consent from all participants before recording any session.

6. Intellectual Property

All rights, title, and interest in and to the App, including all intellectual property rights, are and will remain the exclusive property of Webroom and its licensors. These Terms do not grant you any rights to use Webroom's trademarks, logos, or other brand features.

You retain ownership of any content you create or transmit through the App. By using the App, you grant us a limited, non-exclusive licence to process that content solely to the extent necessary to operate and provide the service.

7. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the App.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Webroom and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the App;
• Any unauthorised access to or alteration of your data;
• Any third-party conduct or content transmitted through the App;
• Any other matter relating to the App.

9. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may stop using the App at any time. To request account deletion, contact us at the address below.

10. Changes to Terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date above. Your continued use of the App after any changes constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.
